An attorney from our previous partnership represented a property owner facing the threat of eminent domain by a pipeline company. The pipeline company filed condemnation documents in the Court of Common Pleas. The pipeline company offered $28,000. An evidentiary hearing was held. Property owner rejected offers up to $175,000 and the owners demanded that the pipeline company avoid the property. The pipeline company rerouted the pipeline to avoid the property. The pipeline company agreed to pay the property owner’s reasonable expenses, including attorney fees, as a result of the property owner’s need to defend the property.
